Dane Reynolds is suing Quiksilver in Delaware court, reports Swellnet.

At issue is $3.59 million bucks purportedly owed to Mr Reynolds, possibly due to a breach of contract stemming from Quik’s inability to remove Dane from promotional materials in a timely manner once he’d abandoned the sinking ship.

Why Delaware?

Because the state is the closest thing to an offshore tax haven that exists within US borders.

The state features minimal taxes, corporate friendly laws, and the ability to operate anonymously. Great place to hide money, avoid paying your fair share. Lawyer wife has been urging Mr Derek to incorporate BeachGrit there for a while. You can do it online, no need to pay Australia’s terrible taxes.

Skirt the upside-down country’s oppressive libel laws to boot. You could still totally sue us, but it wouldn’t be nearly as easy. And I’d get a lot less stuff edited because being mean in the absence of facts is apparently a crime down under.

The article also mentions another suit related to $7.3 million dollars in severance monies owed to former employees.

It’s really no surprise that a bankrupt company is being sued for money owed. After all, that’s the point of bankruptcy. Screwing your creditors.

Once the wife gets home I’ll force her to search the legal databases that totally confuse me. Will report any new information she can shake loose.

You definitely have the venue issue sorted out correctly – Rory couldn’t have fucked that one up any harder. But what’s this about a motion by QS? My assumption here would simply have been that the court needs to review the prior settlement to be sure it wasn’t a fraudulent transfer and nothing more.

Referencing your source so early and efficiently saved you from looking like a real fucking idiot. It also helped that the majority of the piece was based around Delaware’s tax policies. So this I guess, is why Universities are so stringent on reliable referencing.
This said, what really would of saved it would of been waiting for your wife to get home in the first place.

Man… Rory Parker and Beach Grit, you guys are just so off point here. But this is just a matter of course for you guys. Even though Stab isn’t doing a great job of vetting its claims, they’re way more on the mark than this sham of an article.

The original Reuters article’s references to the alleged suit are as follows:

1. “Surfwear retailer Quiksilver Inc and professional surfer Dane Reynolds
are battling over $3.6 million the surfer says he is owed from a
sponsorship deal from before the company went through its bankruptcy
reorganization”

2. “Reynolds’ demand is unjustified because he agreed last year to give up
all claims related to the deal, Quiksilver said in court papers on
Tuesday.”

BUT, the article also notes that the lawyer who is allegedly bringing this claim on Dane’s behalf MIGHT NOT EVEN BE Dane’s lawyer, and it sure seems that Dane doesn’t know what the hell is up, much less support the idea of suing Quiksilver (we can thank Stab for this because… get this… they actually thought it was a good idea to seek comment from the subject of their article).

Apparently, seven days after Dane’s termination agreement was executed, another lawyer (one who didn’t represent Dane during his termination negotiations), “filed court papers on behalf of 10 claimants, including Reynolds.” I, nor anybody else who hasn’t seen these filings (that includes Beachgrit, Swellnet, Stab, etc…) can make any claims about the existence of a lawsuit!

Even more importantly, Reuters article quotes Dane’s ACTUAL lawyers as saying, “There is no ongoing issue or dispute between the parties.”

So even if we assume the author of the Reuters article looked at the actual case filing, why on earth would Dane’s lawyers so confidently deny the existence of a dispute, and why in god’s name would Reuters jump to publish this despite contradictory claims unless they could give evidence about the suit itself, especially since that other lawyer “was not immediately available for comment”? These are questions that anybody reporting on this matter should have been asking before publishing.

I’m not a frequent visitor of this site, but from what I’ve read, I think it’s hilarious that beachgrit fancies itself as some brave “go where others won’t” check on the industry-dependent, neutered surf media. What courage it takes to throw someone under the bus on absolutely baseless claims! Bravo!

Aaaand, just so it’s all in one neat place, and in the hopes of counteracting this shite piece of “journalism,” here’s what I posted on StabMag:

“First of all, Stab should pay their people to do actual research instead of just taking one side’s account.

Second,even if you assume Dane/Blair don’t know what’s actually happening, their statements don’t necessarily suggest that Dane has a suit against Quik. That’s because a termination agreement will list all claims that could potentially arise down the road. So, if Quik’s lawyers looked at Quik’s promo materials and saw that Dane might have a legitimate claim against them at some point, they would list that claim as one of the terms of the termination agreement (or else risk liability for malpractice). All this means is that as soon as Dane signs, he can’t sue them down the road (even if he never intended to), which is the hit he’s willing to take to get out of the sponsorship deal. This $3.6 mil.”claim” might just relate to one of the conditions of his termination agreement, not to an actual lawsuit.

If a bankruptcy court had to go back and review all of Quik’s contracts, that would definitely include Dane’s termination agreement, which means that the (hypothetical) claim is still on the table, until the court approves it. This doesn’t mean Dane would have a suit by default at all, it just shows how messy and public bankruptcies are.

But, if Stab actually did their homework, they’d see that the actual release says that a lawyer from another firm (who hadn’t represented Dane during termination agreements), filed suit against Quik with Dane’s name listed as one of 10 claimants. The lawyer never responded for comment before the article was published, though. Hard to tell whether it’s a case of shitty journalism, or a case of greedy lawyering, but it’s probably safe to assume Dane’s telling the truth when he says he’s not suing Quiksilver.”

once you can make money in Delaware, it’ll be great. my state is the 8th largest economy in the world, and we don’t apply anyone else’s case law unless the parties agreed to it, which Dane’s management apparently did.
