"His use of a sharpened and deadly fin was reckless and displayed a wanton disregard for the safety of others.”
For the first time I can think of, or remember, US courts have been asked to adjudicate on whether or not dropping in on a man and belting him with a leashless log is grounds for damages.
In the case of Olson v Saville (2024), Mark Olson (belted) and Patrick Saville (no leash) were surfing at Mirimar Beach in Montecito, a town described as “a dizzying combination of old wealth, new wealth and outrageous physical beauty that has begun to attract an ever-wider range of dreamers.”
Olson caught a wave, Saville “appeared out of nowhere” and dropped in forcing Olson “to make a fast turn correction to his left toward the beach.”
Olson then “grabbed both [of] his board rails (aka sides) and pushed himself and the nose of the board slightly down and into the foam pile of whitewater toward the deeper water and away from respondent.”
Saville was still riding towards the beach but soon wiped out and his leashless board “propelled backwards and struck Olson’s torso and back.”
Olson sued for negligence.
“(Saville) intentionally entered the wave and intentionally cut off (Olson’s) path of travel, thereby forcing (Olson) to exit the wave.”
Further, Saville’s “failure to use a leash to control [his] longboard” and his use of a “sharpened and deadly fin was reckless and displayed a wanton disregard for the safety of others.”
Saville used the assumption of risk doctrine as his defence. As far as excuses go, it’s a doozy.
“An individual is barred from recovering damages for an injury sustained when he or she voluntarily exposed him or herself to a known danger.”
Now here’s where it gets good. Saville called in Ian “Kangag” Cairns, the testosterone-squirting big-wave icon who said that surfing is an “extreme sport with many inherent risks…Because ‘wipeouts’ are so common, it is a known risk that a surfer may collide with another surfer, or another surfer’s board.”
Kanga, a baseball-bat swinging, send-the-king-of-the-Hui to jail hell-raiser, said surfing is underwritten by an etiquette although “violating this surfing etiquette is common among surfers.”
Kanga said that “many longboard surfers particularly enjoy the challenge and freedom of surfing without a leash” ‘cause legropes “interfere with their footwork and speed.”
He also added that fins “are very sharp and can inflict significant injury.”
How could a court not be swayed?
But here comes Shaun Tomson, Kanga’s old sparring partner from those fabulous mid-seventies Hawaiian winters, on the side of Mark Olson.
Tomson disagreed with Kanga and said that Saville’s conduct was indeed reckless.
“Over time, the sport of surfing has adopted the Surfing Code and Rules of Etiquette,” Tomson told the court. “Surfers have a self-managed obligation to observe the Surfers Code and Rules of Etiquette and not increase the risk of harm to others in the water.”
Tomson said that Saville’s disregard of surfing’s rules was a “conscious and wanton reckless disregard” for another surfer’s safety.
On and on it goes, read it all here.
Anyway, who do you think the court sided with, Kanga or Shaun?
Kanga!
Leashless boards ok!
Good news or have the gates to hell just swung open?

What Da F_CK. good?
assholes and opinions unlimited. until the whip comes down!
Some funny stories came out of that Devereux school. Was at sands one day and one of the autistic kids had escaped. He waddled down the trail plopped down in front of three sunbathing female UC students stuck one hand in his ass crack and started beating off in front of them before being taken back to Devereux.
It’s okay to surf without a leash but when you do, you take on the responsibility to keep your board from hitting others.
The fact that Shaun burns people habitually doesn’t mean there’s no liability.
Ian is full of shit. The activities that are legally considered hazardous, like surfing, carry inherent risk. You can’t sue the owner of a skate park or ski resort because you got hurt in the normal course of the activity. The same goes for hockey or rugby.
If you shoot yourself in the foot at a shooting range, that’s your own problem. If you shoot someone else in the foot, it’s also your problem, legally.
You sure as shit can sue a guy who comes up behind you and throws you into a big bowl at the skate park, shoves you off a cliff when you happen to be strapped into a snowboard, or cold cocks you after a rugby game. The same goes for this guy who dropped in and ditched his board recklessly.
A hazardous activity classification indemnifies a property owner or city parks and rec department responsible for the facility. It does not absolve individuals from failing to take ordinary precautions to avoid injuring others.
Getting pushed into a bowl or off a cliff are not inherent risks of skating or snowboarding.
In surfing getting dropped in on happens to everyone. Leashless longboarders are so common that it’s a hot button issue online, especially so because they surf waves with lots of beginners. But you know this when you paddle out. That’s the distinction being made by the courts here.
Widespread recklessness among participants and the inherent risk of a sport or other activity are not at all the same thing, logically nor legally.
Having someone crash into you on a ski slope happens, too. And the responsible party is liable.
Did you read the case? The court spent a bunch of time talking about how the court is applying the same standard from prior skiing and snowboarding lawsuits. They both require gross negligence.
And this isn’t?
That’s the question.
If skiing into somebody is gross negligence, is longboarding without a standard safety device, failing to follow standard etiquette, and failing to attempt to control the loose board?
There’s a good argument that it is.
That is exactly why they paid Ian to claim that such etiquette doesn’t exist and that the behavior is the norm.
You can’t ever know what a court will decide, but there is a very strong argument that these actions are equivalent to similar ones in similar sports, where there is liability.
See the recent Paltrow case. The was no question that liability could exist. The question was essentially who got whom.
If there’s no liability here, then when is there?
I agree with you and I don’t see why Cairns got involved at all, unless he is friends with the guy.
Guy without the legrope dropped in. Immediately that puts him at fault; we all know this even if its a revenge burn. Don’t drop in is like rule number one of fight club, its the only one that matters.
Then guy without legrope flicks his board into the guy. That’s strike two and he’s lucky he didn’t get a bunch of fives.
Oh and guy without a legrope is… surfing without a legrope that’s sttike 3. It’s not 1970.
Cairns – the wanker – is arguing that you don’t need a leg rope and too bad if you get dropped in on. Fuck off you pretentious kook.
Cairns is an expert witness. He got paid.
So did Shaun, by the other side.
Famished
I hope the impalee doesn’t take the court on a field trip to review Shaun’s “Code” at Rincon. Might be difficult to see through the stickers.
I keep trying to like Shaun but he keeps holding me at arm’s length.
i don’t think miramar qualifies as a ‘surfing’ beach. now if it happened at the rinc or hammonds or the spit, that might be a legit case. no?
Way to protect “secret” spots in North Malibu and blow up Devereax, man. Sheesh!
