There was that one time, right, when some guy cut you off riding an egg shape with flames no less, and it infuriated you. Oh his attitude only made it worse all arrogant and “what, bro, it was my wave…” vibey.

But what if you pulled him underwater for a minute and were then on the line for attempted murder?

This has, apparently, just happened in Hawaii (minus the egg shape with flames and aqua-sox) with a 39 year old man and a 19 year old boy.
Is twenty years too big a gap to rage?
Probably yes!
But should it deserve an attempted murder charge?
Maybe yes!

A 39-year-old man is facing an attempted murder charge in connection with a fight at a North Shore surf spot.
Police say the suspect and a 16-year-old boy were surfing at Velzyland when they got into a fight. Police say the suspect allegedly briefly held the victim underwater .
Police were called and the suspect was arrested at the scene for attempted murder. He has yet to be charged.
And what do you think? If you were a sitting judge would you toss the book at the 39 year old or wink his way and say, “Don’t do it again…” before winking again?

Every surfer when assaulted should press charge, and every surfer thinking of punching out someone should think twice about the consequences. It’s about time violence in the water gets the same treatment as on land. Laws exist to deter violent people from using violence as a means to an end. Unfortunately many surfers degenerate into animalistic self-indulgent behaviour yet are perfectly comfortable hanging on to the most stupidest idea it’s OK because they’re locals… Enough of that lowlife nonsense masquerading as something it’s not.

Attempt charges are very hard to prove. The State would have to prove beyond a reasonable doubt that the old dude was really trying to kill the kid. Often the police arrest people on higher charges than those that can actually be proven in court. The police report will be forwarded to the prosecutors office and they will decide whether to charge the old man and/or the child with a crime – it’s possible the kid instigated a mutual fight or that the old man was defending himself. Also, in situations like this, the kid might decide to not press charges; witnesses? Anyway, there are a host of facts and factors that the prosecuter will consider before charging anyone. Basically, at this point, we don’t shit.
for a hold down too? they’d have to show the guy intended to hold him down until he quit struggling, and did so from a mindset of cool deliberation, not momentary rage. it’ll plea out to simple battery, maybe some enhancement for doing it to a minor, assuming the kid was 16. but if the kid came at him, he’s got self defense as an out for the whole enchilada.
Depends on what the assailant was riding. Anything longer than 6’8″ and he should get life. That’ll teach him.
