Eventually Hawaii isn’t going to look like Hawaii anymore — it’s going to be a resort community. Are we really thinking about 100 years from now, what this island is going to look like?”
Zuckerberg, for his part, also has his Palo Alto neighbors enraged.

His sneaky use of paid proxies to sue the rightful Hawaiian owners by forcing those property owners to auction is the same tactic that sugar barons and plantation owners employed to steal and displace other Hawaiian kuleana land owners from their land. Those sued have and had a no-win choice, they could either sell their small parcels or try to outbid a billionaire at public auction. If they lost they would be forced to pay Zuckerberg’s legal fees.

Aloha nui Polo. Your question is reasonable and it really does seem illogical that a land owner can somehow be forced to sell and/or otherwise give up their property. Quiet title reform is needed in Hawaii and evolving case law and further challenges may indeed help. The issues can be quite convoluted, complicated and nuanced. Money and the power it wields still rules the day and as our present jurisprudence system has proven time and time again, if you get forced into a legal scrap the party with the $$ and armies of high-priced litigators is sure to prevail. And for sure, the greasing of Hawaii’s notorious corrupt government plays a big role.
If anyone is interested the links provided here might provide some insight but I warn you it won’t be long before your eyes roll back and slumber is induced. The first is a fairly succinct and comprehensive overview of Zuck’s Kaua’i property history and the other is a Hawaii court case from about a year ago where the Hawaii Intermediate Court of Appeals overturned a lower court and ruled in small measure against Zuck.

I think the only way to resolve any of this besides taking a firehose to the capital and cleaning the entire place out, is to pass a bill that requires land purchaser(s) that acquire more than 10 acres of land, must deed one acre per ten to the Hawaiian community. ie: Zuck has 2000 acres, 200 of that should be deeded to Hawaiian to develop and live on rent free. The land should be allotted through a lottery. Imagine 200 Hawaiian families being deeded an acre (per family) of land on Kauai, 0r Oprah’s and Bezos land on Maui, SalesForce land on Hawaii……..that can be handed down through generations.

IF Zuck’s goal is focused on conserving the lands and waters on which all life depends for the Hawaiian people I’d be ok with his efforts. BUT I believe his goal is to create a barrier for himself and his family. So Hawaii should claim back meaningful tracts of his land to build affordable housing for Hawaiians via eminent domain
friend of mine owns Kualoa Ranch on Oahu.
the ranch is supported through tourism activities, cultural tours and the film industry. JM preserves the land while offering a great opportunity to enjoy the beauty of Oahu. it is self sustaining and there are about 80 houses on the property provided to employees of the ranch. The Ranch actually supports the community and is open for everyone to enjoy. It such a beautiful place that it would truly be a shame just to buy the land to “preserve” it, and not share it it with the community.
recently I went on an ATV tour on Kauai. one of our favorite things to do on Kauai. Over the years, when we did this tour, it went through the some brilliant land, to a waterfall where we could swim and had some incredible trails.guides were knowledgable in the history and culture of Kauai. It was a great tour.
a new land owner purchased the land a few years ago and cut off access. about year later, I met a woman who worked for the man, who told me about her family and his employees recent boondoggle to Kauai and how nice it was to stay on the land in one of his many properties, secured by fences and no-one around except his company employees. How nice it was to have no-one there except they and his staff that catered to their every wish. She told me about going to the waterfall for swimming, horseback riding, atv riding, private helicopter tours, the wonderful parties under the stars and completely secluded from outsiders.
How nice for a billionaire from the mainland to cut off access and “preserve” 1000’s of acres of land on Kauai for him and his friends and employees Private Retreat….and to exclude dwellers of the outside world…..except of course for deliveries, catering staff, housekeepers and hired help.
Hawaiian should be on their knees thanking him and Zuck for their virtuous preservation motives.
